What to do if ICE approaches you: Know Your Rights

Whether you’re a U.S. citizen, a green card holder, a student on a visa, or undocumented, you have legal rights.

  1. If ICE agents come to your home:

    • You do not need to open the door unless they have a warrant signed by a judge. You can ask them to pass the warrant under the door or through a window to check before opening the door for them.

  2. If ICE agents come to your work or approach you in a public place:

    • Do NOT run. Stay calm and ask, ‘Am I being arrested or detained?’ If not, walk away calmly.

  3. In any situation:

    • You have the right to remain silent. You do not have to answer their questions.

    • You have the right to call your attorney.

    • Do not sign anything before consulting your attorney.

  4. Have an emergency plan:

    • Keep all of your documents in a safe place. Make sure you and your family always have your lawyer’s number on hand.
